SB 1105 Summary

• Authorizes the Department of Alcoholic Beverage Control to issue new "SEF-BFPEP licenses" (on-sale general for sports entertainment facility bona fide public eating place licenses) allowing retail sale of beer, wine, and distilled spirits for on-premises consumption at sports entertainment facilities with capacity exceeding 10,000 people.

• Sets original license fee at $13,800 and annual renewal fees consistent with other on-sale general bona fide public eating place licenses, with fees deposited in the Alcohol Beverage Control Fund.

• Permits authorized licensees (manufacturers and importers) to purchase advertising space and time at sports entertainment facilities from facility owners or major tenants under specified conditions, subject to department oversight and declarations.

• Requires on-sale licensees to serve competing brands of beer, wine, and distilled spirits when authorized licensees have purchased facility advertising, preventing exclusive brand arrangements.

• Makes existing advertising provisions in Sections 25503.6 and 25503.8 inoperative as of December 31, 2022, replacing them with new requirements for written declarations and regulatory oversight of advertising agreements.
