SB 1172 Summary

• Repeals Chapter 211 of the Statutes of 1919 and grants three parcels of tidelands and submerged lands in San Francisco Bay to the City of Albany in trust for public purposes consistent with the public trust doctrine.

• Requires the City of Albany to submit an approved trust lands use plan to the State Lands Commission by January 1, 2022, and submit utilization reports every five years starting September 30, 2022.

• Permits the City to lease trust lands for up to 49 years and retain revenues, with 20% of gross revenue transmitted annually to the State Lands Commission (80% to General Fund, 20% to Land Bank Fund).

• Establishes conditions on the trust grant including prohibition on alienating the lands, requirements for fair lease rates, non-discrimination in rates and charges, and state rights to use lands for highways and fishing without compensation.

• Authorizes the State Lands Commission to enforce compliance with trust terms and revert all rights to the state if the City substantially fails to improve or maintain the lands or unreasonably delays implementation of the use plan.
