SB 1318 Summary

• Authorizes local agency formation commissions (LAFCs) to initiate proposals for annexation of disadvantaged unincorporated communities lacking adequate drinking water or wastewater services.

• Prohibits LAFCs from approving annexations over 10 acres to cities or qualified special districts (500+ service connections providing water/wastewater) if a contiguous disadvantaged community exists, unless that community's annexation is also filed.

• Requires LAFCs to identify disadvantaged unincorporated communities by January 1, 2018 and every five years thereafter, and adopt written accessibility plans by January 1, 2020 addressing service inefficiencies and strategies for service extension.

• Requires service plan applicants to describe currently provided services and indicate when new services can feasibly be extended, and requires cities and counties to incorporate accessibility plans into their general plans during housing element updates.

• Imposes state-mandated local program requirements on LAFCs and local agencies to conduct service reviews, file maps of disadvantaged communities lacking safe drinking water or adequate wastewater, and hold public hearings in affected areas with 30-day notice to residents.
