Restores the Department of Toxic Substances Control's authority to impose hazardous waste facility postclosure plan requirements through enforcement orders or enforceable agreements, in addition to postclosure permits.

Requires the department to adopt regulations for imposing postclosure plan requirements on or before January 1, 2018.

Mandates public notice and opportunity for public comment before the department initially approves or significantly modifies a postclosure plan, with CEQA compliance required.

Establishes fee requirements for owners/operators submitting postclosure plans as enforcement orders or enforceable agreements, and provides the department with enforcement remedies including injunctive relief and civil penalties for violations.

Exempts postclosure plans with final or draft permits issued on or before December 31, 2003, unless the department and facility mutually agree to replace the permit with an enforcement order or agreement.
