• Expands the definition of "tobacco product" to include electronic cigarettes and vaping devices that deliver nicotine or vaporized liquids, subjecting them to the same restrictions and penalties as traditional tobacco products.

• Changes the penalty for furnishing tobacco products (including e-cigarettes) to minors from an infraction to a misdemeanor under the STAKE Act, with civil penalties ranging from $400-$6,000 depending on violation frequency.

• Extends smoking prohibitions and regulations to include use of electronic smoking devices in schools, workplaces, public transportation, vehicles with minors, and other restricted locations.

• Requires retailers selling non-taxed tobacco products (including e-cigarettes) to obtain a license with a one-time fee determined by the State Board of Equalization, effective October 1, 2016.

• Defines "smoking" to include use of electronic smoking devices that create aerosol or vapor, and applies existing smoking restrictions statewide to these devices while preserving local authority to impose stricter regulations.
