CA SB417

Requires law enforcement officials to detain individuals on Immigration and Customs Enforcement holds for up to 48 hours (excluding weekends and holidays) after they become eligible for release if they have been convicted of or arrested for specified crimes and continued detention would not violate federal law.

Removes the requirement that detention comply with state or local law or policy, instead requiring compliance with federal law only.

Imposes a $100,000 fine per violation on local agencies that fail to detain individuals as required, with fines collected by the Attorney General and deposited in the Restitution Fund.

Authorizes the Attorney General to commence civil actions to enforce the fines against non-compliant local agencies.

Provides that if the Commission on State Mandates determines the bill creates state-mandated costs, reimbursement to local agencies shall be made pursuant to existing statutory procedures.
