SB 447 Summary

• Establishes separate reimbursement formulas for contraceptive versus non-contraceptive drugs, devices, and supplies provided by licensed community clinics, free clinics, and intermittent clinics under Medi-Cal and Family PACT programs.

• Requires clinics to bill at the Medi-Cal reimbursement rate for contraceptive drugs, devices, and supplies.

• For non-contraceptive drugs, devices, and supplies, clinics bill at the lesser of their usual charge to the general public or their cost, with the clinic dispensing fee determined by the department or calculated as the difference between actual acquisition cost and Medi-Cal reimbursement rate.

• Requires the Department of Health Care Services to seek federal approval for necessary state plan amendments and adopt implementing regulations by July 1, 2018, with semiannual status reports to the Legislature until regulations are adopted.

• Permits temporary implementation through provider bulletins or similar instructions prior to formal regulation adoption, conditioned on federal financial participation and approvals.
