CA SB739

Prohibits school district governing boards from authorizing new charter schools to locate outside district boundaries if the district receives a negative certification under Section 42131.

Allows charter schools unable to locate within their chartering district to establish one site outside district boundaries but within the county if the affected district, county superintendent, and State Superintendent are notified and either suitable facilities are unavailable or the site is needed temporarily for construction or expansion.

Expands charter school petition requirements to include detailed suspension and expulsion procedures with enhanced due process protections, including formal hearings and appeals to county boards of education.

Modifies admission preferences to require public hearings for any preferences beyond district residents, and prohibits preferences that would limit access for students with disabilities, low-achieving students, English learners, homeless students, and economically disadvantaged students.

Incorporates conforming amendments coordinating with SB 322 (regarding Section 47605) and AB 2659 (regarding Section 47605.1) if both bills are enacted before January 1, 2017.
