SB 892 Summary

• Creates the San Bernardino County Transportation Authority as a successor agency consolidating the powers, duties, revenues, debts, and liabilities of the San Bernardino County Transportation Commission, local transportation authority, service authority for freeway emergencies, and congestion management agency.

• Establishes the authority's governing body consisting of five county supervisors, one mayor or city council member from each incorporated city in San Bernardino County, and one nonvoting gubernatorial appointee.

• Reorganizes Division 20 of the Public Utilities Code by restructuring chapters into articles and renumbering sections while maintaining the authority's existing power to impose a retail transactions and use tax subject to voter approval and voter-approved bonding authority.

• Authorizes the San Bernardino County Transportation Authority to conduct a value-pricing program on Interstate 10 and Interstate 15 corridors, including high-occupancy toll lanes, with revenues used for transportation improvements and excess revenues dedicated to transit and congestion reduction projects.

• Transfers all assets, liabilities, contracts, and retirement fund obligations from the consolidated agencies to the new authority by operation of law and establishes this as a state-mandated local program subject to reimbursement provisions.
