Imposes a 10% fee on the consumption or use of medical marijuana purchased from retailers, effective January 1, 2018, unless a specified cannabis legalization initiative passes in November 2016.

Exempts low-income purchasers (income below 200% of federal poverty guidelines) from the fee if they present a Medical Marijuana Program identification card.

Requires medical marijuana identification cards to indicate whether the cardholder has low income, and mandates retailers to register permits and collect the fee separately from the purchase price.

Establishes the Marijuana User Fee Fund to distribute collected revenues as follows: 30% to the General Fund, 30% to local agencies for marijuana regulation enforcement, 20% to state parks, and 20% to counties for drug and alcohol treatment programs.

Directs the State Board of Equalization to administer fee collection and requires the Legislative Analyst to review and report on the fee biennially beginning in 2018.
