Beginning September 1, 2018, home care aides' names, telephone numbers, and cellular telephone numbers on file with the Department of Social Services must be made available upon request to labor organizations representing home care aides or in-home supportive services providers.

Labor organizations receiving this contact information are prohibited from using it for any purpose other than employee organizing, representation, and assistance activities, and cannot disclose the information to other parties.

The department must establish a simple opt-out procedure allowing registered home care aides to request that their contact information not be disclosed to labor organizations.

By July 1, 2018, the department must provide written notice to all registered home care aides explaining that their information may be shared with labor organizations and instructions for using the opt-out procedure.

No state reimbursement is required for implementation costs because the bill only creates new requirements under existing criminal penalties, not new crimes or infraction liability.
