CA AB1746

Amends Penal Code Section 784.7 to add sexual battery (Section 243.4) and unlawful sexual intercourse (Section 261.5) to offenses where jurisdiction can be established in any county where at least one offense occurred when multiple violations involve the same defendant and victim across jurisdictions.

Requires prosecution to present written agreement from all affected district attorneys at a Section 954 hearing before consolidating charges in a single jurisdiction for sexual assault offenses under Sections 220, 261, 262, 264.1, 269, 286, 288, 288.5, 288.7, and 289.

Authorizes courts to consider evidence location, offense distribution, defendant and victim rights, and witness convenience when determining whether to join multiple counts in one county for prosecution of human trafficking and related offenses.

Incorporates amendments proposed by Senate Bill 1494 through Section 1.5, which becomes operative only if both AB 1746 and SB 1494 are enacted and effective by January 1, 2019.

Approved by Governor on September 30, 2018 and filed with Secretary of State the same date.
