Full-service restaurants are prohibited from providing single-use plastic straws to consumers unless the consumer specifically requests one.

Single-use plastic straws are defined as disposable tubes made predominantly of plastic (petroleum or biologically-based) used to transfer beverages, excluding straws made from paper, pasta, sugar cane, wood, or bamboo.

First and second violations result in a notice of violation; subsequent violations are infractions punishable by a fine of $25 per day, not to exceed $300 annually.

Enforcement is authorized to local health officers and environmental health specialists under the California Retail Food Code framework.

Local jurisdictions may adopt additional ordinances that further restrict single-use plastic straw provision beyond state requirements.
