Amends Penal Code Section 17 to allow courts to declare a crime a misdemeanor when granting probation, regardless of whether the court imposes a sentence.

Previously, courts could only declare an offense a misdemeanor if probation was granted without imposing a sentence; this bill removes that limitation.

Maintains existing law allowing courts to designate offenses as misdemeanors in other circumstances, including after non-prison punishments and at preliminary examination.

Preserves existing restrictions on sex offender registration requirements, which remain mandatory regardless of felony or misdemeanor designation.

Approved by Governor June 1, 2018 and filed with Secretary of State same date.
