Manufacturers of electrically conductive balloons must permanently mark each balloon with the manufacturer's identity and a warning statement about fire risk from contact with electrical power lines.

Sellers or distributors of electrically conductive balloons filled with lighter-than-air gas must affix a weighted object to counteract lift and cannot attach them to electrically conductive strings, tethers, streamers, or other conductive objects.

Releasing electrically conductive balloons outdoors as part of public events, civic activities, or product advertisements is prohibited and punishable by a fine not exceeding $100 for first and second violations.

A third violation of the outdoor release prohibition becomes a misdemeanor offense.

Manned hot air balloons and balloons used in governmental or scientific research projects are exempt from these requirements.
