Chronic dialysis clinics, surgical clinics, and rehabilitation clinics must comply with federal certification standards in effect immediately preceding January 1, 2018, until the State Department of Public Health adopts its own regulations.

Intermediate care facilities for developmentally disabled individuals must comply with federal certification standards for intermediate care facilities for individuals with intellectual disabilities (42 CFR Sections 438.400-438.480) until state departments adopt regulations.

State Department of Public Health and State Department of Developmental Services shall jointly develop and implement licensing regulations for intermediate care facilities serving developmentally disabled populations.

No state reimbursement is required because costs stem from changes to criminal penalties related to violation of facility standards.

The bill takes effect immediately as an urgency statute to allow early enforcement of federal certification standards.
