Allows entities to take migratory nongame birds incidental to otherwise lawful activities if they submit written certification to the Department of Fish and Wildlife and implement best management practices intended to avoid significant adverse impacts to the birds.

Requires entities to submit annual reports by January 31 each year after initial certification, describing implemented best management practices, any failures to implement, and scope of impacts to migratory nongame birds.

Exempts accidental take occurring on farms or ranches during routine agricultural activities from certification and best management practice requirements.

Directs the Department of Fish and Wildlife to establish compliance guidelines by December 31, 2019, through a public stakeholder process, specifying procedures for certifications, reports, and methods for verifying compliance.

Provides incidental take authority becomes effective immediately upon certification and continues unless the department issues a noncompliance notification within 120 days, during which entities remain in compliance during a specified grace period.
