AB 2836 Summary

• Requires University of California Regents to establish systemwide and campus-level Native American Graves Protection and Repatriation Act (NAGPRA) Implementation Committees as a condition for using state funds to handle Native American human remains and cultural items.

• Mandates UC adoption and implementation of policies by January 1, 2020 addressing culturally appropriate treatment, repatriation claims procedures, dispute resolution, and disposition of "culturally unidentifiable" remains in compliance with federal and state law.

• Requires UC to develop all policies in consultation with California Native American tribes on the Native American Heritage Commission's contact list and submit policies to the Commission for review and comment by July 1, 2019.

• Establishes that campus committees must receive all repatriation claims and violations, with appeals going to a systemwide committee; requires procedures for appeals and dispute resolution when tribes disagree with campus determinations.

• Directs the California State Auditor to conduct audits in 2019 and 2021 on UC's compliance with federal and state repatriation laws and report findings to the Legislature.
