Personal vehicle sharing programs must stop facilitating transportation with a vehicle within 48 hours after a manufacturer's recall notice appears in the National Highway Traffic Safety Administration (NHTSA) recall database or within 48 hours of receiving recall notification from a contracted third party.

Recalled vehicles cannot be used for personal vehicle sharing until the recall notice no longer appears in the NHTSA recall database.

Personal vehicle sharing programs are not liable for accuracy errors or omissions in recall database reports or for information added to the database after obtaining their own recall database report.

The bill applies the same recall restrictions previously established for rental car companies (with 34 or fewer vehicles) to personal vehicle sharing programs.

Changes do not apply to pending litigation and do not affect the determination of whether a company qualifies as a rental car company or personal vehicle sharing program.
