Law enforcement agencies, medical facilities, crime laboratories, and other facilities storing sexual assault evidence kits must audit all untested kits in their possession and report findings to the Department of Justice by July 1, 2019.

Audit reports must include the total number of untested kits and specific data for each kit such as collection date, pickup dates by law enforcement, delivery date to crime lab, and reason for non-testing (unless victim declined prosecution, in which case only the count is reported).

The Department of Justice must prepare and submit a summary report to the Legislature by July 1, 2020, detailing the audit information received from all facilities.

Section 680.4 of the Penal Code is repealed on July 1, 2024.

If the Commission on State Mandates determines this act imposes state-mandated costs on local agencies or school districts, reimbursement shall be made pursuant to existing statutory procedures.
