Authorizes the Department of Transportation to offer leases to the City of Oakland on a right of first refusal basis for airspace under freeways or real property acquired for highway purposes located in Oakland.

Lease uses are limited to emergency shelter or feeding programs for up to 10 parcels at $1 per month plus an administrative fee not to exceed $500 per year.

Allows advance payment of monthly rental fees to reduce administrative costs associated with recurring monthly payments.

Department may charge a higher administrative fee if determined necessary to cover administration costs.

Declares that leasing real property under this section serves a public purpose.
