AB 3199 Summary

• Repeals exemptions for charitable auctions from firearm transfer requirements and replaces them with a limited authorization allowing nonprofits to conduct no more than 3 auctions, raffles, or similar events per year for firearms other than handguns.

• Requires all firearms sold at nonprofit auctions, raffles, or similar events to be transferred through a licensed dealer who must conduct background checks and enforce waiting periods pursuant to all legal requirements.

• Repeals previous sections (26955, 27655, and old 27900) that waived waiting periods and other transfer requirements for firearms sold at charitable auctions.

• Adds new Section 26851 authorizing nonprofits to deliver non-handgun firearms to licensed dealers for processing at auctions and raffles, with local chapters limited to 3 such events per calendar year.

• Imposes a state-mandated local program with no state reimbursement required, as the law only creates or changes the definition of existing crimes.
