Amends Section 1281.2 of the Code of Civil Procedure to change the language regarding grounds for denying arbitration from "revocation" to "rescission" of an agreement.

Adds a new provision (subdivision d) preventing enforcement of arbitration agreements when a depository institution created the contractual relationship fraudulently without the consumer's consent and using their personal identifying information on or after January 1, 2018.

Maintains existing exceptions to arbitration enforcement including waiver of the right to compel arbitration and conflict with pending court actions involving third parties.

Preserves the court's authority to delay arbitration orders when other unresolved issues between parties may render arbitration unnecessary.

Approved by Governor on July 16, 2018 and filed with Secretary of State the same day.
