State Air Resources Board must enhance certification, audit, and compliance activities for new motor vehicles to detect defeat devices and software used to evade emissions testing, including increased use of in-use and real-world conditions emissions testing.

State board may consult or partner with academic institutions and laboratories to develop new surveillance methods, perform emissions testing, and conduct research on vehicle emissions.

State board authorized to impose fees on new motor vehicle manufacturers to recover costs of implementing enhanced certification and compliance activities, capped at $5,000,000 in fiscal year 2018-19 and limited to annual increases matching California Consumer Price Index and operational/labor costs.

Manufacturers failing to pay fees within 60 days face 10 percent additional charge; failure to pay within one year incurs 100 percent additional charge; failure to pay within two years incurs 100 percent penalty for each additional one-year period unpaid.

Creates Certification Fund and Certification Penalty Account in State Treasury, with collected fees deposited in Certification Fund and penalties/charges deposited in Certification Penalty Account, both available upon legislative appropriation.
