SB 1035 Summary

• Requires cities and counties to review and revise the safety element of their general plans to address climate adaptation and resiliency strategies, rather than just reviewing and updating as necessary.

• Mandates the planning agency review and revise the safety element upon each revision of the housing element or local hazard mitigation plan, but no less frequently than once every 8 years, to identify new information on flood hazards, fire hazards, and climate adaptation strategies.

• Establishes that the safety element must include climate vulnerability assessments, adaptation and resilience goals and policies, and feasible implementation measures using natural infrastructure where appropriate.

• Creates a state-mandated local program, with the state providing no reimbursement because local agencies have authority to levy service charges or fees sufficient to pay for the mandated requirements.

• Coordinates with AB 3160 such that if both bills are enacted, only Section 1.5 of this bill becomes operative, incorporating amendments from both bills.
