Authorizes a person whose personal identifying information was unlawfully used in a business entity filing to petition superior court for a determination of unlawful use, provided they have obtained a police report as required under existing law.

Court may issue an ex parte order requiring the alleged perpetrator and the person using the personal identifying information to appear and show cause why the information should not be labeled as impersonated.

Upon finding unlawful use, the court must order the name and personal identifying information in the business entity filing to be redacted or labeled to show the data is impersonated.

Court must order removal of the personal identifying information from publicly accessible electronic indexes and databases.

Judicial Council must develop a court form for issuing the order of determination, which shall be filed with the Secretary of State.
