CA SB1268

Prohibits alcoholism or drug abuse recovery and treatment facilities, their owners/officers/shareholders (10%+), and employees/counselors from giving or receiving remuneration or anything of value for referring persons seeking treatment services.

Extends the same prohibition to alcohol or other drug programs certified by the State Department of Health Care Services under certification standards.

Makes violations a misdemeanor punishable by fines up to $2,500 per violation.

Authorizes the department to investigate violations and take disciplinary action including assessing penalties, suspending or revoking licenses/certifications, and recommending suspension or revocation of professional licenses.

Allows the department to implement and interpret the law through provider bulletins and written guidelines until formal regulations are adopted.
