Exceptions to the double the base term cap include sentences required by enhancements or terms under Penal Code sections involving gang crimes (186.22, 186.33), human trafficking (236.4, 269), sexual offenses (667.6, 667.61, 288.3), three-strikes laws (667, 667.5, 667.51, 1170.12), and certain firearm enhancements (12022.75, 12022.9).

Modifies sentencing rules for enhancements with three possible terms, requiring courts to impose the middle term unless aggravating or mitigating circumstances exist and are stated on the record.

Applies to all portions of sentences not covered by the statutory exceptions, ensuring the double the base term limitation cannot be entirely eliminated by the presence of a single exception.

The amended provision takes effect January 1, 2022, with a sunset provision unless extended by later legislation.
