Certified delivery networks must obtain a Department of Alcoholic Beverage Control license before delivering alcoholic beverages sold by off-sale retail licensees, with licenses to be issued by January 1, 2020.

Delivery personnel must be at least 21 years old, verify recipient age with bona fide identification, refuse delivery to obviously intoxicated persons, and refuse delivery to college campuses.

Off-sale retail licensees retain control over product selection, pricing, order acceptance, and merchant of record status; certified networks can charge up to 10 percent above retail price plus delivery fees.

Noncertified delivery networks may operate under stricter requirements limited to beer and wine only, with deliveries between 12:00 p.m. and 9:00 p.m., and must charge only the retailer's price plus delivery fees.

Department may charge fees to cover actual and reasonable administrative costs for the licensing and approval program.
