Prohibits criminal prosecution for overpayments or overissuances of CalWORKs or CalFresh benefits if the county human services agency received Income and Eligibility Verification System (IEVS) data match information indicating potential overpayment but failed to provide timely and adequate notice of collection action to the person.

Establishes that county human services agencies are deemed to have received IEVS data match information 45 days after their possession of that information.

Allows the 45-day receipt period to be extended by any authorized delay if the agency has not completed required IEVS actions within 45 days due to exceptions under federal regulations.

Maintains existing criminal penalties for willful fraud, false statements, multiple applications, counterfeiting benefits, and unauthorized use or transfer of CalFresh benefits and authorizations.

Approved by Governor September 30, 2017, and effective as Chapter 390.
