Authorizes the Department of Transportation to lease airspace under freeways or real property acquired for highway purposes in Los Angeles and San Jose to each city or their political subdivisions for emergency shelter or feeding programs on a right of first refusal basis

Sets lease amount at $1 per month for up to 10 parcels in each city, with optional advance payment allowed to reduce administrative costs

Requires an administrative fee not to exceed $500 per year, unless the department determines a higher fee is necessary to cover administrative costs

Declares that leasing real property for emergency shelter or feeding programs serves a public purpose
