Amends Civil Code Section 3294 to require courts to inform juries prior to deliberation that defendants are permitted to claim tax deductions on punitive or exemplary damages as ordinary and necessary business expenses.

Applies to all actions where punitive or exemplary damages are sought.

Requires a majority vote for passage (not a two-thirds vote).

Does not require fiscal committee review.
