SB 914 Summary

• Expands authorization for counties and certain public entities to use construction manager at-risk construction contracts for infrastructure projects exceeding $1,000,000, including buildings, utility improvements, flood control, underground utilities, and bridges, but excluding roads.

• Allows public entities where county board of supervisors members make up the governing body to utilize these contracts with approval of the governing body.

• Requires construction manager at-risk entities and subcontractors to use skilled and trained workforce for apprenticeable occupations unless a project labor agreement is in place or was entered before January 1, 2018.

• Limits retention proceeds withheld from construction manager at-risk entities to 5 percent if a performance and payment bond is required, with restrictions on passing excessive retention to subcontractors.

• Sunsets this authorization on January 1, 2023, unless extended by later enacted legislation.
