AB 1080 Summary

• Establishes the California Circular Economy and Plastic Pollution Reduction Act, requiring producers of single-use plastic packaging and priority single-use products to source reduce packaging and ensure all such products manufactured after January 1, 2032 are recyclable or compostable.

• Mandates the Department of Resources Recycling and Recovery achieve and maintain a statewide 75% reduction of waste from single-use packaging and priority single-use products by January 1, 2032 through source reduction, recycling, and composting.

• Requires producers to register and report data to the department, meet specified recycling rates (30% by 2028, 40% by 2030, 75% by 2032), and pay a California circular economy regulatory fee; establishes penalties up to $50,000 per day per violation for noncompliance.

• Allows producers to collectively form stewardship organizations to meet requirements through approved stewardship plans; prohibits retailers and wholesalers from selling products from noncompliant producers.

• Restricts local agencies from requiring grocery stores to use specific food packaging unless majority of households have access to curbside programs accepting that material; provisions sunset January 1, 2032.
