Beer manufacturers may give up to five cases of retail advertising glassware per licensed location per calendar year to on-sale retail licensees at no charge, provided the glassware bears conspicuous beer advertising.

On-sale retail licensees may accept up to 10 cases of retail advertising glassware per licensed location annually from beer manufacturers and must not sell, give away, or return the glassware for cash, credit, or replacement.

Beer manufacturers and on-sale retail licensees must keep records for three years of all glassware given or received; manufacturers must file records with the Department of Alcoholic Beverage Control within 30 days of delivery.

Beer wholesalers are prohibited from underwriting, sharing, or contributing to glassware costs or serving as agents to deliver, stock, or store glassware for on-sale retailers.

These provisions expire and are repealed on January 1, 2023.
