Classifies employees who provide instruction at independent institutions of higher education as employed in a professional capacity, exempting them from wage and hour provisions under Wage Order No. 4-2001 or No. 5-2001.

Requires instructional employees to meet a duties test and receive either a monthly salary of at least two times the state minimum wage, or payment calculated at specified weekly rates per classroom hour ($117 in 2020, $126 in 2021, $135 in 2022, with increases tied to state minimum wage thereafter).

Exempts qualifying educational employees from overtime compensation requirements under Labor Code Sections 226, 510, and 512.

Allows employees covered by a collective bargaining agreement that expressly classifies them as employed in a professional capacity to qualify for the exemptions without meeting the salary requirements.

Specifies that non-lecture courses (laboratories, art studios, clinical courses) offered for the same number of credits as lecture-based courses must receive the same minimum weekly payment.
