AB 187 Summary

• Revises the Used Mattress Recovery and Recycling Act by requiring the mattress recycling organization to review and potentially amend its plan every five years, beginning in 2020.

• Requires the organization to maintain financial reserves not exceeding 60% of annual operating expenses starting January 1, 2027, with department authority to allow up to 75% if necessary for implementation.

• Establishes new reporting and planning requirements including research activities on illegal dumping, pilot programs to test new collection methods, and prioritization of in-state processing facilities over out-of-state facilities where economically practical.

• Creates an orderly transition process when the department decertifies a mattress recycling organization, allowing the decertified organization to continue operations for up to 12 months or directing funds into a trust account pending successor certification.

• Prohibits revenue from the mattress recycling charge from being used to pay civil penalties imposed on the organization.
