Exempts local educational agencies (school districts, county offices of education, and charter schools) from fiscal penalties for failing to meet minimum instructional day requirements beginning with the 2021–22 school year if they add instructional minutes to existing days equivalent to no more than 15 instructional days within the same school year.

Requires local educational agencies to establish that they could not meet instructional day requirements due to specified circumstances including inclement weather or causes listed in Section 46392 (fire, flood, earthquake, epidemic, military/civil emergency orders, extraordinary conditions, teacher shortage, or teacher illness).

Mandates that exempted local educational agencies submit affidavits from governing board members and the county superintendent of schools to the department within 30 calendar days certifying that minimum instructional day requirements were not met.

Requires that compliance with the exemption include approval from the exclusive representative of any impacted bargaining unit.

Specifies that compliance must be verified in the annual audit report of the local educational agency, with audit findings addressing non-compliance as required under Section 41344.
