Commencing July 1, 2021, annual rate adjustments for foster family agencies shall be calculated using the California Necessities Index, rounded to the nearest dollar, excluding rates for certified family homes or resource family agencies.

The State Department of Social Services must convene a stakeholder workgroup including former foster youth, advocacy organizations, and foster family agency social workers to identify measures for establishing adequate funding and compensation for foster family agency social workers.

The department must submit specific recommendations to the Legislature by December 31, 2022, regarding a foster family agency rate structure to ensure foster family agency social workers are adequately compensated and reduce worker turnover.

Annual rate adjustments remain in effect until both the department submits its recommendations to the Legislature and establishes a new foster family agency rate structure ensuring adequate social worker compensation.

Recommendations submitted to the Legislature are not binding on any state or local government agency.
