Allows a single member of a school or community college district personnel commission to declare that a conflict exists between the commission's interests and the governing board's interests.

Requires such declarations by commission members to be approved by majority vote of the commission before a conflict is found.

Permits the commission to employ its own attorney if a conflict is declared and approved, with costs charged against the district's general funds.

Applies these provisions to both school districts (Section 45313) and community college districts (Section 88132) of the Education Code.

Maintains existing authority for legal counsel to refuse representation when conflicts are known or reasonably suspected, and requires counsel to respond to representation requests within 15 working days or be deemed to have refused.
