State Department of Education must develop and post guidance on its website for local educational agencies (K-6th grade) participating in the federal School Breakfast Program on how to serve breakfast or morning snacks to eligible nonschoolaged children.

Defines "eligible nonschoolaged child" as a non-enrolled child who is a sibling, half-sibling, step-sibling, or foster child of a pupil eligible for free or reduced-price breakfast.

Requires a guardian to be present at the school site for a nonschoolaged child to receive breakfast or morning snack.

Department must establish a process for state reimbursement (upon legislative appropriation) to local educational agencies for meals served to both nonschoolaged children and their guardians, and must seek federal waivers if necessary to secure federal reimbursement.

Department must evaluate the guidance and submit findings to the Legislature by January 1, 2023, including data on participating agencies, meals served, families served, and any implementation issues.
