Amends Section 25249.11 of the Health and Safety Code to allow small businesses employing fewer than 10 employees to voluntarily waive their exemption from Proposition 65 enforcement by providing written notice to the party giving notice of violation and the Attorney General.

Modifies the definition of "person in the course of doing business" to permit small employers to opt into Proposition 65 liability on terms and conditions they specify in writing.

Requires a two-thirds vote of each house of the Legislature for passage, as Proposition 65 can only be amended by such a supermajority vote.

Makes minor language changes from "his or her" to "the person's" for gender-neutral terminology in the statute.

Includes legislative finding declaring the bill furthers the purposes of the Safe Drinking Water and Toxic Enforcement Act of 1986.
