AB 3052 Summary

• Establishes the Forced or Involuntary Sterilization Compensation Program administered by the California Victim Compensation Board to provide compensation to survivors of state-sponsored sterilization under California eugenics laws (1909-1979) and survivors of coercive sterilizations in California prisons after 1979.

• Requires the board to conduct outreach to locate qualified recipients, verify applications using institutional records and databases, and affirmatively identify and disclose sterilizations that occurred in California prisons to individuals who may not know they were sterilized.

• Provides two payment phases: an initial payment within 60 days of board determination (calculated as half of anticipated total funds divided by qualified recipients), followed by a final payment after all appeals are exhausted using remaining funds.

• Exempts victim compensation payments from state income taxation, means-tested program calculations, child support enforcement, restitution collection, and money judgment enforcement, while allowing assignment to trusts and designation of beneficiaries.

• Becomes operative only upon legislative appropriation to the board and relevant state departments; requires annual reporting to the Legislature on application status, approvals, demographics (in aggregate), and outreach methods while maintaining confidentiality of individual claimant information.
