AB 3155 Summary

• Exempts small multifamily housing projects (10 or fewer units) from certain affordability requirements if they comply with local inclusionary housing ordinances or pay a fee to the local government.

• Requires local agencies to issue building permits for subdivisions of 10 or fewer lots where at least 75% of the perimeter adjoins parcels with urban uses, provided the applicant has received tentative or parcel map approval and recorded a covenant.

• Conditions the building permit on the developer recording a covenant stating that a certificate of occupancy will not be issued unless the final map is recorded and the total units do not exceed 10.

• Streamlines the approval process by allowing local agencies to issue building permits based on the approved map and its conditions of approval without additional hearing requirements.

• Remains in effect only until January 1, 2026, when the section will be repealed.
