CA SB1005

Prohibits local educational agencies, officers, and employees from entering into, extending, or renewing confidentiality agreements with child predators effective January 1, 2021.

Prohibits officers and employees of local educational agencies from providing favorable recommendations or otherwise facilitating the employment of child predators by other local educational agencies.

Defines "child predator" as persons convicted of child abuse or neglect as defined in Penal Code Section 11165.6, convicted of sex offenses under Section 44010 against persons under 18 years old, or suspended or terminated for inappropriate behavior toward pupils.

Makes officers and employees liable for damages proximately caused by knowingly or negligently failing to comply through concealing information or making false communications, with courts authorized to award attorney's fees to prevailing parties.

Defines "confidentiality agreement" as a contract preventing disclosure of information about the criminal violation or unacceptable behavior that caused a child predator's termination.
