SB 107 Summary

• Extends skilled nursing facility quality assurance fee assessment from July 31, 2020 to December 31, 2022, with repeal effective January 1, 2024.

• Establishes enforcement mechanisms for delinquent quality assurance fees including 7% annual interest charges, deductions from Medi-Cal payments, penalties up to 50% of unpaid amounts, and authority to delay facility ownership transfers until debts are paid.

• Exempts freestanding pediatric subacute care units from quality assurance fee requirements beginning August 1, 2020 and thereafter.

• Modifies skilled nursing facility reimbursement rates with specific aggregate increases (3.5% for 2021, 2.4% for 2022) and requires audits of COVID-19 related Medicaid payments to ensure funds were used for allowable patient care costs.

• Allows counties to extend Mental Health Services Act funding allocation deadlines for 2020–21 fiscal year due to COVID-19, permits use of prudent reserves for housing assistance, and delays fund reversions from July 1, 2019-2020 to July 1, 2021.
