Expands the crimes of gross vehicular manslaughter while intoxicated and vehicular manslaughter while intoxicated to include the unlawful killing of a fetus, in addition to human beings.

Applies to drivers in violation of Vehicle Code sections 23140, 23152, or 23153 (driving under the influence laws) where the killing results from an unlawful or negligent act.

Maintains existing penalties: gross vehicular manslaughter while intoxicated punishable by 4, 6, or 10 years in state prison; 15 years to life for repeat offenders.

Vehicular manslaughter while intoxicated remains punishable by up to one year in county jail or 16 months to four years in state prison.

Specifies that no state reimbursement is required for local agencies or school districts as the costs fall under the exception in Government Code Section 17556 for crimes with changed penalties or definitions.
