SB 235 Summary

• Authorizes County of Napa and City of Napa to enter into a mutual agreement allowing one jurisdiction to report housing units approved by the other jurisdiction in their annual housing production report to the Department of Housing and Community Development.

• Requires both the County Board of Supervisors and City Council to hold public hearings and make written findings based on substantial evidence before approving such an agreement, including findings that the agreement will not cause segregation and meets specific site requirements.

• Clarifies that jurisdictions must maintain adequate housing inventory to meet their regional housing need allocations, and any failure to do so after entering such an agreement constitutes a violation of state housing law subject to Attorney General notification.

• Expands the requirement for regional housing need allocation reductions to apply to subregional entities, not just councils of governments.

• Changes the streamlined housing development approval process to base eligibility determinations on net new units with completed entitlements, building permits, or certificates of occupancy, rather than only building permits.
