Prohibits tobacco retailers from selling, offering for sale, or possessing with intent to sell flavored tobacco products or tobacco product flavor enhancers, defined as products imparting a characterizing taste or aroma other than tobacco (including fruit, chocolate, mint, menthol, candy, and similar flavors)

Exempts flavored shisha tobacco products sold by hookah tobacco retailers that prohibit anyone under 21 from entering the premises and comply with all relevant state and local tobacco laws

Exempts premium cigars sold in cigar lounges where products are purchased and consumed only on premises, and exempts loose leaf tobacco and premium cigars from the prohibition

Violation is punishable as an infraction with a $250 fine per violation

Does not preempt local ordinances that impose greater restrictions on tobacco product access; local restrictions prevail in case of conflict
