Make intentional theft of wages exceeding $950 from a single employee, or $2,350 in aggregate from multiple employees within any consecutive 12-month period punishable as grand theft.

Define "theft of wages" as intentional deprivation of wages, gratuities, benefits, or other compensation due under law through unlawful means.

Include independent contractors within the definition of "employee" and hiring entities within the definition of "employer" for purposes of this section.

Authorize recovery of stolen wages, gratuities, benefits, or compensation as restitution while preserving employees' rights to pursue civil actions through the Labor Commissioner.

Approved by Governor September 27, 2021, with no state reimbursement required for local agencies or school districts.
